The Russian Investigative Committee has submitted to the Prosecutor General's Office and the State Duma the results of its verification of entrepreneurial activity of deputy Gennady Gudkov, Investigative Committee spokesman Vladimir Markin told Interfax on Monday.
"A procedural decision will be made on the basis of the pre-investigation check, but information about Gudkov's failure to comply with the restrictions, bans and obligations imposed by the constitution and laws of the Russian Federation, which was obtained in the procedural verification, has already been sent to the Prosecutor General and the State Duma Speaker for making decisions within the limits of their competence," he said.
The Committee's Main Investigative Department continues the procedural verification of the illegal entrepreneurial activity of Gudkov, i.e. elements of a crime defined by Article 289 of the Russian Criminal Code.
"The pre-investigation check revealed that Gennady Gudkov, a deputy of the State Duma and a State Duma Committee Deputy Chairman - a public officer, acquired a share in the authorized capital of LLC Kolomensky Stroitel in September 2008 under a deed of gift," the Investigative Committee representative said.
After that the deputy and his wife signed the founding contract and contributed to the authorized capital monetary funds at the amount of his share (65.72 percent). "At a shareholder's meeting Gudkov approved a new edition of the company charter and, being actually and legally a shareholder and a member of the managerial body, controlled and continues to control the company, appoints directors, makes decisions on the distribution of revenues and the formation of the authorized capital and takes other actions in the interests of this legal entity," he said.
"Also, according to information of the Russian Central Elections Commission and the Federal Tax Service, Gudkov has been the only shareholder of LLC Roshan since December 25, 2008. He is the only member of the company's managerial body (the shareholders' meeting) and recipient of revenues," Markin said.
